Introduction

These Terms of Use ("Terms") govern your access to and use of this website and any pages or content we make available through it (collectively, the "Site"). The Site is operated by Magnolia Memory Care of Flower Mound ("Magnolia," "we," "us," or "our"), a memory care community located in Flower Mound, Texas.

By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Site.

Eligibility

You must be at least 18 years old and capable of forming a legally binding contract to use the Site. By using the Site you represent that you meet these requirements.

Pricing and availability information on the Site is subject to change and should be confirmed directly with our team before you rely on it.

Tours, pricing & residency agreements

Nothing on the Site is an offer to reserve a suite, place a resident, or otherwise establish a business relationship with Magnolia. Any placement, move-in, or care arrangement is subject to an assessment of the prospective resident's needs and a separate written Residency Agreement between Magnolia and the resident or their legal representative.

Descriptions of floor plans, pricing, and availability on the Site are general and may change; current pricing and availability should be confirmed directly with our team.

Acceptable use

You agree to use the Site only for lawful purposes and only in a manner consistent with these Terms. You agree not to:

  • Use the Site in any way that could disable, overburden, damage, or impair it, or interfere with any other party's use of the Site.
  • Use any robot, spider, scraper, or other automated means to access the Site for any purpose without our prior written consent, except for ordinary search-engine crawling consistent with our robots.txt.
  • Attempt to gain unauthorized access to any portion of the Site, including any account, server, or system associated with the Site.
  • Probe, scan, or test the vulnerability of any system or network connected to the Site, or breach any security or authentication measures.
  • Use the contact form or any other input feature to transmit unsolicited promotional material, malware, or any content that is unlawful, harassing, defamatory, or infringing.

Subject to your compliance with these Terms, Magnolia grants you a limited, revocable, non-exclusive, non-transferable license to access and view the Content on the Site for your personal, non-commercial use. IN ANY EVENT, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL. Indemnification

You agree to indemnify, defend, and hold harmless Magnolia, its affiliates, and their respective officers, directors, members, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Site, (b) your violation of these Terms, or (c) your violation of any rights of any third party. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate in our defense.

Governing law and venue

These Terms, and any dispute arising out of or related to the Site, are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. You agree that the exclusive jurisdiction and venue for any action arising out of or related to these Terms will be the state and federal courts located in Denton County, Texas, and you consent to the personal jurisdiction of those courts. You waive any objection based on inconvenient forum.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. If we make material changes, we will take reasonable steps to notify you, including by posting a notice on the Site. Your continued use of the Site after an update constitutes acceptance of the revised Terms.
